Original Purchase Property Description:  NW 1/4 of the NE 1/4 - the NE 1/4 of the NW 1/4 & the W 1/2 of the NW 1/4 of Sec. 17, Twp 49, Rng 2E in the District of Lands Subject to Sale at Palmyra, Missouri, containing 170 acres.

This Deed Property Description:  NE 1/4 of the NW 1/4 - W 1/2 of the NW 1/4 of Sec. 17, Twp 49, Rng 2E in the District of Lands Subject to Sale at Palmyra, Missouri, containing 130 acres.


This Deed, made and entered into this Eighth day of September, Eighteeen hundred and Sixty, by and between Richard C. DORSEY of the County of Lincoln in the State of Missouri, party of the first part, Shapleigh B. WOLFOLK of the County of Lincoln in the State of Missouri party of the Second part, and Edwin HASTINGS of the County of Lincoln, in the State of Missouri, party of the third part: Witnesseth, That the Said part of the first part in consideration of the debt and trust herein after mentioned and created, and of the Sum of One Dollar to him paid by the said party of the Second part, the receipt of which is hereby acknowledged, do by these presents, grant, bargain and sell, convey and confirm unto the said party of the Second part, the following described tracts or parcels of land situate in said County of Lincoln to wit:    The N. East quarter of the N West quarter and the West half of the N. West quarter of Section Seventeen in Township 49 of Range two East in the district of lands subject to sale at Palmyra containing One hundred and thirty acres more or less.  To have and to hold the same, to the said party of the Second part, and to his heirs, assigns, executors, administrators or assignees forever.  In trust, however for the following purpose:  Whereas the said Richard C. DORSEY is indebted to the said Edwin HASTINGS in a promisory note, for Four hundred & seventy eight 75/100 dated  Sept 8, 1860, and payableto the order of Said HASTINGS One year after date with interest from date at the rate of ten per cent per annum.  Now if the said note shall be well and timely paid according to the term thereof - when it shall become due and payable, then this Deed shall be void and the property herein before conveyed shall be released at the cost of the said party of the first part but if default be made in payment of said note on an part thereof when it becomes due and payable this Deed shall remain in force and the said party of the Second part or his legal representative or in case of death or absence from the State the Sheriff of the County may proceed to sell the property herein before described or any part thereof at public auction to the highest bidder at the Court House done in the city of Troy for cash, first giving twenty days of public notice of the times terms and place of said sale and of the property to be sold by advertisement in some newspaper printed and published in the County of Lincoln and upon such sale, shall execute and deliver a Deed in fee simple of the property sold to the purchaser or purchasers thereof, and receive the proceeds of said sale; out of which he shall pay first the costs and expenses of executing this trust, including compensation to the Trustee for his services and next the note herein described & interest therein and the remainder if any, shall be paid to the said party of the first part or his legal Representative.  And the said part of the Second part, convenants faithfully to perform and fulfill the trust herein created.  In witness whereof the said party have hereunto set his hand and seal this day and year first above written.

DORSEY who is to be personally known to be the same person whose name is subscribed to the foregoing instrument of writing asparty?, thereto, and acknowledged the same to be his act and deed for the purposes therein mentioned:

The Interlineation between the Second and third lines on the Second page of the words "for Four hundred & seventy eight 75/100 dollars" & the word of "order of" between the Second & third lines of same page were there when this deed was acknowledged.
